Can i use a part of a song from late 70's in a current song without getting sued?

i want to sample a part of a famous singer's song and use it in a song of mine. The song was done in the late 70's, but i dont know if i should seek copyright permission first. i intend to use the singer's voice just like kanye west does. Will i get sued ?

You have to get permission first if you don't want to risk a lawsuit.
